Federal Arrest Procedure

Contact An Experienced Federal Defense Lawyer Before You are Arrested

Experienced defense lawyer Steve Hisker will immediately get between you and the federal authorities.  If the situation requires you to talk to federal agents or the federal grand jury, Steve Hisker will be able to advise and prevent you from accidentally waiving your important constitutional rights.

Arrest and Bond Hearing

If the federal authorities are going to charge you, Steve Hisker will accompany you at all stages of your arrest and detention hearing.  Having an attorney before this process is important.  Steve can contact the authorities to arrange for you to turn yourself in and avoid the embarrasment of being arrested in front of your family or employer.  Your privacy is an important part of the attorney-client relationship.  Steve will strive to keep your name and photos out of the media spotlight.  

Steve will accompany you to your first appearance before the United States Magistrate.  There he will present arguments that you should be released on the lowest bond possible.  An unsecured bond is often referred to as being released on your personal recognicance or P.R..  The judge will consider the issues of flight risk and danger to the community.  Steve Hisker will argue that you are not a flight risk by highlighting your ties to the community such as home ownership, steady employment and family support.  The judge will also consider if your attorney made arrangements for you to turn yourself in before being arrested.   The second factor the federal court will consider before you are released is danger to the community.  Although you may be facing a serious or even violent charge, you are presumed innocent.  Steve will argue that the nature of the current charge is not relevant to establish you as a danger to the community.

Arraignment

Your first appearance in South Carolina Federal Court is called an arraignment.  Steve Hisker will advise you of the nature of your charges and the possible penalties before you appear in court.  Having an experienced federal lawyer at your arraignment will often allow you to waive a formal reading of the charges.  If you are charged with a federal drug offense, Steve Hisker will fight the government's attempt to have you detained without bond.  After you have been fully advised of the charges and possible penalties, we will enter plea of not guilty to the charges.
