Original Charge: Trafficking 190 lbs Marijuana

Facts: Client was arrested in a traffic stop on I-85 in Spartanburg. Charged
with Trafficking 190 lbs marijuana. Client was facing 25 year mandatory
minimum with no parole. State offered a plea bargain with a 10 year parole
eligible sentence. Client rejected this offer and went to trial. Case
was first up on the trial docket the week of January 26, 2015 and the
trial concluded on January 29. Jury was out deliberating for 2 hours and
returned with a unanimous verdict of NOT GUILTY. Client went home free.

: Defendant was charged with CDV after an altercation with his wife. Defendant
maintained that victim was the aggressor. Defendant denied doing anything
to wife and stated that victims injuries were self inflicted. Defendant
was offered PTI and refused to enter the program. Defendant demanded a

Charge: Felony DUI with Great Bodily Injury (passenger was paralyzed).
Court: Aiken County General Sessions Court; Aiken, SC
Maximum Penalty- Defendant faced up to 15 years in prison.
History- Defendant involved in a single car accident. Passenger was paralyzed
as a result of the accident. Defendant had a blood alcohol level of 0.16
(more than twice the legal limit). Defendant was previously represented
by another lawyer. Defendant believed that he was going to receive between
5 and 15 years in prison. Defendant fired prior lawyer and hired Steve
Hisker. Steve Hisker did a thorough investigation, even took pictures
of the refrigerator where the blood was stored in the evidence locker.
Steve Hisker then negotiated a favorable result.
Result: 40 days weekend jail, 1 year house arrest and probation to follow.
